Per SDCL 35-4-11.4. Special malt beverage retailers’ license-Special retail on-sale wine-dealers’ license-Maximum period of validity-Necessary security for street dance. Any municipality or county may issue a special malt beverage retailers’ license and a special retail on-sale wine dealers’ license to any civic, charitable, educational, or fraternal organization in conjunction with a special event within the municipality or within the county. Educational does not include any elementary, secondary, or higher educational institution in the public school system of this state. Any license issued pursuant to this section requires the licensee to follow all other SD codified laws that apply to sales or consumption of alcoholic beverages. Any license issued pursuant to this section may be issued for a period of time established by the municipal governing body or board of county commissioners. However, such period may not exceed fifteen consecutive days. If an organization receiving a license pursuant to this section conducts a street dance in conjunction with the special event, the organization shall provide qualified security personnel as deemed necessary by the governing body which issued the license to maintain order during the street dance.

This license requires an inspection of the premises by the Building Inspector and Fire Marshal to ensure that the premises conform to the provisions of Code and other ordinances of the city and the laws of the state. A police check is conducted by our local Police Department, which takes about one week and needs to be done prior to submitting the application to the City Commission. Processing of this application takes two consecutive City Commission meetings. (City Commission Meetings are held the second and fourth Mondays of every month.) First meeting is to set the date of the Public Hearing. Second meeting is the Public Hearing for approval of the license. The applicant should be present at this meeting in case commissioners have any questions. Deadline for submission of application is at least one week prior to the first of the two consecutive City Commission meeting dates. A conservative estimate would require the applicant to begin this process by stopping in the Finance Office six weeks prior to the actual event.
